Confusion in Texas: What Forms of Cannabis are Legal?


The short answer is that, while they both come from cannabis plants, hemp and hemp-derived products are generally legal in Texas, and marijuana is not. A story posted on CBS19 says that some forms of cannabis were legalized in Texas, in 2019, while others were not. And there is much confusion around the state regarding enforcement.

While enforcement seems to vary depending on jurisdiction, the cannabis laws in Texas are actually clear about what is and is not legal. Possession of marijuana remains illegal in the state, while hemp is now legal, keeping in line with federal regulations. However, hundreds of pending marijuana cases have been dropped throughout the state of Texas, because crime labs lack the ability to detect precise THC content.
